Picente said he’s not sure what a settlement in such a lawsuit would look like, but the county has taken corrective actions, which includes hiring additional board of elections staff. Picente said the letter from the Justice Department was not necessarily a surprise due to the errors in the election and the high-profile nature of the congressional race. The county executive and Legislature have limited involvement with the board of elections, Picente said, aside from approving commissioners put forth by the political parties and the board’s budget. Since the review ended, both county election commissioners - Republican Rose Grimaldi and Democrat Carolann Cardone - resigned from their positions. Those errors accounted to violations of Help America Vote Act. The Justice Department letter said hundreds of the rejected ballots fell into two categories: those previously registered in the state database to vote, and those with valid voter registration applications that were not processed as required by law. Those ballots eventually were canvassed as part of the review, and votes were added to the totals. The judicial review also discovered nearly 1,800 affidavit ballots were administratively rejected without verification. Claudia Tenney, R-New Hartford, ahead of incumbent Democrat Anthony Brindisi by 109 votes. Brindisi conceded in February after the state Board of Elections certified Tenney’s victory, rather than seeking an appeal.
